Misconduct by prosecutors in California
samedi 20 août 2016 à 02:00California is considering a bill to make it a felony for a prosecutor to withhold or falsify evidence.
This seems to be a response to gross, persistent misconduct by prosecutors in Orange County.
Such misconduct is currently a misdemeanor. I tend to think that the prospect of being convicted of a misdemeanor would be enough to deter prosecutors from committing this crime; but it seems they usually get away with no penalty at all. Perhaps if it is a felony they will really be punished.
